Experience:

David Chadwick practices insurance law, focusing in particular on policies involving political risk, financial risk, professional indemnity and reinsurance. He is championed by clients as "a great all-rounder and is one of the industry's greats" (Chambers and Partners UK Directory 2009 ). Clients have described him as "among the top experts in this area, and appreciated his 'straight-to-the-point style and commercial, quality advice'" (Chambers UK 2007).

Described as absolutely a market leader in political and trade risks work in Chambers UK 2008, David has significant experience advising political risk insurers in relation to the adjustment and defence of claims involving all types of political risk policies, including confiscation (CEND), contract frustration and contingency (change of law) policies. He has advised clients on credit insurance policies where the risk insured can be consequent upon political acts, has considered countless jurisdictional issues and has handled claims involving investments into or trade involving Cuba, India, Pakistan, Lebanon, Montenegro, Macedonia, Serbia, Brazil and parts of the former USSR. He regularly assists clients in the drafting of political risk policies and in assessing the types of risks that need to be insured against in particular jurisdictions.

David also handles a range of claims on behalf of insurers who underwrite financial risk. He advises insurers in relation to many notified claims arising from the FSAVC and Endowment reviews, as well as many other types of claim emanating from the banking, building society and finance house sector. His experience includes consideration of the position of finance houses as constructive trustees and defending fund administrators.

David handles a wide range of professional indemnity matters covering professionals such as surveyors, management consultants, solicitors and investment brokers. He has particular experience with regard to defending the position of insurance brokers, both in relation to the traditional principal/agency relationships and with regard to their obligations under binding authorities. David also acts regularly for reinsurers in relation to claims involving both treaty and facultative business, and he has a special interest in disputes concerning rights of inspection.

In addition to representing clients in insurance litigation and other related claims, David assists both insurers and insureds in pre-contractual risk assessment evaluations, policy reviews and drafting, and he has significant experience assisting the firm's corporate department on insurance aspects of mergers and acquisitions. He has been instrumental in assisting various brokers in the drafting of warranty and indemnity policies, and he has advised insurers in relation to the restructuring of contracts pursuant to subrogation strategies.

Notable Engagements:

Advising insurers in relation to circumstances surrounding the political risk coverage of a power project in Asia; the relevant limit of liability was in excess of US$190 million.

Advising insurers in relation to political risk coverage of sugar stocks held in warehouses in Cuba.

Assisting political risk insurers in debt restructurings involving smelting plants in Montenegro and sugar refineries in Brazil.

Advising brokers in defence of allegations made against them involving a binding authority involving travel insurance.

Defending insurers in relation to multiple claims arising from the FSAVC and Endowment reviews.
