David Dolkas Biography :

David Henry Dolkas is an experienced intellectual property litigator, trial lawyer and partner in the Intellectual Property, Media & Technology Department in the law firm of McDermott Will & Emery LLP based in the Silicon Valley office. Dave concentrates his practice primarily on patent litigation; however, he has extensive experience with trade secret, trademark, unfair competition and complex commercial litigation.

Dave has extensive trial experience representing clients in numerous jury trials involving patent infringement, trade secret misappropriation, breach of contract and complex product liability. He has served as lead counsel and has successfully represented defendant-companies in high-stakes punitive damages jury trials. Dave's experience spans a wide variety of commerce, including the internet, technology, the defense industry, the pharmaceutical industry and, most recently, the mobile wireless industry.

Since 2006, Dave has served as co-lead counsel in matters for Qualcomm Incorporated in patent litigation matters pending in the International Trade Commission and district courts.

In 2004 and 2005, Dave was co-counsel with partner Terry McMahon and successfully sued Atmel Corporation and Sumitomo Bakelite on behalf of the Firm’s clients, Seagate Technology and Fairchild Semiconductor. The suits involved the sale and manufacturing of allegedly defective semiconductors made with a molding compound sold by Sumitomo Bakelite.

Previously, Dave was among a group of attorneys selected from firms across the country designated to serve as local trial counsel on behalf of Bayer Corporation in the In Re Baycol Mass Tort Litigation, a complex mass tort action involving the cholesterol-lowering drug Baycol. In addition to his role as a member of the national trial team, Dave also was the internal firm coordinator of over 400 cases filed in California, Pennsylvania and Minnesota.

In addition to his trial experience, Dave has arbitrated numerous cases before court-appointed arbitrators, the NYSE, the American Arbitration Association and the Judicial Arbitration and Mediation Services, Inc.

Dave is a recognized leader in the area of managing complex technology and using technology to manage complex litigation. Since 2002, Dave has served as an adjunct professor at Santa Clara University School of Law, teaching classes on managing complex intellectual property litigation. In 2007, Dave designed and taught a class on e-Discovery at Santa Clara University School of Law - one of the first law school classes to be taught on this subject. Dave has served as a presenter at numerous bar and professional association meetings on topics relating to managing complex litigation and intellectual property litigation.

Dave is admitted to practice in California and in numerous federal courts, including the U.S. Court of Appeals for the Ninth Circuit, the U.S. District Courts for the Northern, Central and Southern Districts of Colorado, the District Court of Colorado, the District Court of New Jersey, the District Court for the Southern District of New York, and the Eastern District Court of Virginia.
