Daniel Deitrick Biography :

Daniel W. Deitrick joined the law firm of Marshall, Dennehey, Warner, Coleman & Goggin as an associate in 2000. He currently devotes his practice to the defense of workers' compensation and Federal Black Lung matters.

Daniel has handled over 900 workers' compensation matters in his career to date, not including up to 50 Federal Black Lung matters.

He has represented a considerable number of sports manufacturing companies, trucking companies, hospitals, nursing homes, school districts, vehicle manufacturers, hotels, restaurants, electronic manufacturers, construction companies, public transportation entities, grocery/retail stores, and mines, among others.

Of the roughly 900 claims litigated to date, approximately 40% have been litigated to conclusion. Of those litigated to conclusion, a high percentage have resulted in a favorable outcome for his clients, with most settlements coming in well below the original settlement demand.

For example, Daniel successfully defended a workers' compensation fatal claim involving a motor vehicle accident by demonstrating that the decedent claimant was not an employee of his client for the purposes of the Pennsylvania Workers' Compensation Act, while also establishing that the decedent claimant was not in the course and scope of his employment at the time of the fatal accident.

He successfully defended against a claimant's allegations of entitlement to the maximum temporary total disability rate for a compensable injury by proving that the time-of-injury average weekly wage was properly calculated pursuant to Section 309(d.1) of the Workers' Compensation Act. See Collier v. W.C.A.B. (PRS/Engles Trucking), 805 A.2d 1267 (Pa. Cmwlth. 2002).

Daniel attended Villanova University, where he graduated in 1990 with a major in Political Science and a minor in English. He then attended Duquesne University School of Law and was awarded his Juris Doctorate in 1993.

He was hired as an associate in the Carnegie-based firm of Keisling & Associates, P.C., concentrating his practice in the litigation of insurance defense, workers' compensation, and Federal Black Lung cases. In 1997, Daniel became a partner and shareholder in the firm of Keisling, Schmitt, Coletta & Deitrick, P.C., and continued to develop his practice in the aforementioned areas.

Daniel has been awarded an AV Peer Review Rating by LexisNexis Martindale-Hubbell. He is a member of the Pennsylvania Bar Association and Allegheny County Bar Association.

He is a Little League Coach for Ingomar - Franklin Park Athletic Association.
