Daniel J. Tyson has over 30 years of experience as trial counsel in civil litigation in New York courts, federal courts, and arbitration. His experience includes contract and real property disputes, enforcing creditors’ rights, medical and engineering malpractice defense, health care issues, petroleum and environmental contamination remediation, construction contracts, mechanics liens and labor material and performance bonds, real property valuation for eminent domain, tax certiorari proceedings, and business dissolutions.
Mr. Tyson represents lenders, secured and unsecured creditors, landlords, mechanics lienors, and trustees in bankruptcy and business bankruptcy proceedings. The scope of his bankruptcy work includes protecting creditors’ and clients’ rights during the debtor’s bankruptcy proceedings, negotiating plans of reorganization in bankruptcy proceedings, litigating claims by creditors and defending debtors’ and trustees’ claims against creditors, and restructuring distressed creditor-debtor relationships prior to the debtor’s potential bankruptcy.
Significant cases in which Mr. Tyson was counsel include In re Acquisition of Easements by Albany County Airport Authority, 265 A.D.2d 720, 696 N.Y.S.2d 305 (3rd Dept., 1999), a case on airport navigation easement takings in eminent domain proceedings, and In the Matter of Scott Mathews, 225 A.D.2d 142, 650 N.Y.S.2d 373 (3rd Dept., 1996), a case on the use of a gastrostomy feeding tube to hydrate and nourish a developmentally disabled adult who did not have the ability to consent and who did not have a duly authorized agent to make decisions for him.
Mr. Tyson is admitted to practice in the State of New York. He is admitted to practice before the United States District Court for the Northern District of New York; the United States District Court for the Southern District of New York; the United States District Court for the Eastern District of New York; the United States District Court for the Western District of New York; and the United States Court of Appeals, Second Circuit. He is a member of the New York State Bar Association, the Albany County Bar Association, the Capital Region Bankruptcy Association, and the American Bar Association. |
