Mr. Magee graduated from Hampden-Sydney College in 1976 with a B.A. degree in English and received his J.D. degree in 1979 from Washington & Lee University School of Law in Lexington, Virginia. In college he was active in a number of areas of college life, including academic and athletic, and was elected to Omicron Delta Kappa. While there, he represented the college at the U.S. Naval Academy Foreign Affairs Conference and later interned for the U.S. Senate Public Works Committee in Washington, D.C. At graduation, he received The Algernon Sydney Sullivan Award in recognition of his accomplishments and of his service to the college community. In law school, he was on a moot court team and competed in regional moot court competitions. After law school, Mr. Magee served as law clerk to Chief United States Bankruptcy Judge H. Clyde Pearson from 1979 through 1981. Since then, he has been in private practice.Mr. Magee has extensive experience in business-related legal issues, focusing primarily on distressed businesses and individuals engaged in business. He has an active insolvency practice which includes non-bankruptcy workouts, turnarounds, restructurings, and bankruptcy proceedings. Much of his practice is devoted to counseling buyers, sellers, debtors, trustees, and others in the purchase and sale of distressed businesses and distressed debt. Since founding Magee, Foster Goldstein & Sayers in 1986, he was a court-appointed trustee in bankruptcy for 15 years, and has been lead counsel for debtors, creditors, and secured lenders in over 100 chapter 11 bankruptcy cases. He represents and provides advice to a wide range of businesses and individuals in business including start-ups, high-tech, distribution, manufacturing, transportation, healthcare, pharmaceuticals, natural resources, and real estate development. In addition to his bankruptcy practice, he has represented clients and handled workouts for large and small local, regional, and national lenders, borrowers, and investors. He has a multi-state practice and has been involved in many of the largest bankruptcy proceedings in the United States.Mr. Magee holds an AV rating by Martindale-Hubble, has been named Roanoke Valley, Virginia's "Top Bankruptcy Lawyer" by the The Roanoker magazine since 2003, is listed as one of Virginia's "Legal Elite" by Virginia Business magazine, is listed among "Best Lawyers in Bankruptcy" in Corporate Counsel magazine, was named a "Super Lawyer" in Richmond Magazine in 2006, and was recognized among "The Best Lawyers in America - Bankruptcy, Creditor-Debtor Rights" by Woodward/White, Inc. for 2007. He has written and published extensively and has been quoted in the Wall Street Journal, Forbes, Washington Post, Richmond Times-Dispatch, Roanoke Times, and other regional and national publications. In addition, he received a President's Volunteer Service Award from the Roanoke Bar Association for pro bono work for 2005 - 2006. Currently an adjunct professor of law at Washington & Lee University School of Law, Mr. Magee has also been a moderator and lecturer for Virginia Continuing Legal Education programs, American Bankruptcy Institute, and national, regional, and local credit and other professional organizations. He serves on the Law Council (governing board) at Washington & Lee University School of Law. He is a member of the Bar of the Supreme Court of the United States, the Virginia State Bar, the Virginia Bar, and the Roanoke Bar Association. He is an avid pilot with private pilot instrument ratings for airplanes and seaplanes. Magee, Foster Goldstein & Sayers, founded by Mr. Magee in 1986 as a bankruptcy boutique, is widely considered by its peers as one of the premier insolvency firms in the Southeast. Mr. Magee resides in Roanoke, Virginia with his wife and three children.
