Benoit Keane Biography :

Benoît Keane is an associate in the Brussels office of the international law firm of McDermott Will & Emery/Stanbrook LLP. He advises on European Union law and is a member of the Firm's European Competition group.

Benoît Keane's competition practice focuses upon antitrust, State aid and merger control before the European and national competition authorities.

Benoît has extensive experience in EU law, representing clients before the EU institutions and European Court of Justice. He provides advice on the free movement of goods, the free movement of persons and the exhaustion of intellectual property rights within the EU. He has substantial experience in drafting submissions on proposed new EU legislation and advising upon the EU legislative procedures. Benoît has particular experience in the application of European law to sport.

Benoît Keane read law in University College Cork in Ireland and obtained a master's degree in European law at the College of Europe, Bruges in Belgium. He qualified as a solicitor in England & Wales having worked in the United Kingdom, France and undertaken a stage with the European Commission. Benoît's native language is English and he is fluent in French.

Benoît is a member of the Editorial Board of the competition law journal World Competition. He has written numerous articles on developments in European law, including "The Shadow of Silhouette", Yearbook of European Law (2000), "Levi Strauss v Tesco's", Common Market Law Review (2002) and "Facing the challenges ahead: Enlargement of the EU and State aid", The European Lawyer (2004).

Benoît is a member of the Law Society of England and Wales and the Brussels Bar.

Representative Experience:

Assisting in the defense to an antitrust litigation before national and European courts.

Advising on the impact of competition law upon the joint selling of media rights.

Notifying mergers to the European Commission, Irish and UK competition authorities.

Representing an applicant before the European Court of First Instance in order to obtain access to documents held by the EU.

Drafting submissions to the European institutions on proposed draft legislation and advising upon the potential impact of proposed amendments to draft legislation.

Advising on the application of the Treaties of Accession of the new Member States.

Advising UK regional development authorities on investing in major redevelopment projects in order to comply with State aid and public procurement rules.

Advising investors on the State aid implications of acquiring companies in new EU Member States who have received illegal State aid.
