Andrew Frisch Biography :

Mr. Frisch is a partner in the Firm’s Financial Services Group. He has practiced criminal law in New York City for over twenty-three years as both a prosecutor and defense attorney. He has prosecuted or represented clients in hundreds of criminal matters and investigations, tried over twenty felony cases and briefed and argued over 100 appeals. In Mr. Frisch's first trial upon joining LeClairRyan, he won acquittal after jury trial for a client charged in Brooklyn federal court with extortionate collection of credit.Before joining LeClairRyan, Mr. Frisch worked for eleven years for the United States Department of Justice as a federal prosecutor in the Eastern District of New York, serving as Senior Litigation Counsel in the Office’s Business and Securities Frauds and Public Integrity Units and as the attorney-in-charge of the Office’s criminal environmental practice. Mr. Frisch investigated and prosecuted securities and accounting fraud, insurance and health care fraud, criminal violations of the Clean Air and Clean Water Acts, criminal maritime violations, tax evasion, trafficking in counterfeit trademarks, racketeering, money laundering, wire and mail frauds and obstruction of justice. Among Mr. Frisch’s most significant cases, he tried the chief financial officer and senior vice presidents of finance and worldwide sales of a billion-dollar high technology company for securities and accounting fraud based on manipulation of the company’s general ledger, improper revenue recognition, fraudulent non-recurring charges in violation of Generally Accepted Accounting Principles and obstruction of internal investigations required by the Securities Exchange Commission. Mr. Frisch successfully prosecuted New York City employees responsible for the 2003 crash of the Staten Island Ferry that killed eleven passengers, developing and successfully pressing a groundbreaking theory of federal executive criminal liability against the City’s Director of Staten Island Ferry Operations. In addition, he successfully tried a New York City landlord for violating the Clean Air Act by directing undocumented aliens to scrape thousands of feet of asbestos from a commercial building in preparation for a $50 million lease; won the first case that upheld application of the federal health care fraud statute to New York State’s no-fault insurance law; and successfully prosecuted an Internet "pump and dump" stock fraud, international shipping companies for covering-up ocean-dumping of waste oil, and a ring that smuggled millions of counterfeit Marlboro cigarettes from China into the United States for resale on a Native American reservation. Before becoming a federal prosecutor, Mr. Frisch worked at one of New York City’s most respected white collar defense firms. On Mr. Frisch's first criminal appeal as a defense attorney, he obtained reversal of a physician's conviction in the United States Court of Appeals for the Second Circuit. At the subsequent retrial, Mr. Frisch's first jury trial as a defense attorney, he successfully moved a United States District Judge for a judgment of acquittal after presentation of the defense case. In addition, in a case against an attorney charged with concealing foreign ownership of an American bank from the Federal Reserve Board, Mr. Frisch successfully moved before trial for dismissal of a charge of conspiracy. Mr. Frisch began his career as an Assistant District Attorney in Brooklyn, investigating New York City police officers for fatal shootings of civilians, successfully trying a veteran officer for reckless use of his firearm and helping to start the office’s environmental crimes practice.
