Andrew Skroback’s practice includes all aspects of environmental law, with emphasis on complex litigation and transactional and business counseling. Mr. Skroback’s practice includes the prosecution and defense of complex environmental actions, site investigation and remediation, negotiations with regulatory agencies, joint defense efforts among private parties, and litigation in federal and state courts. His background includes representation of corporate clients at large PCB-contaminated sediment Superfund sites. Additionally, Mr. Skroback helps clients assess the environmental risks associated with mergers, acquisitions, and other business and commercial real estate transactions by conducting environmental due diligence, preparing and negotiating environmental provisions in transactional documents, and providing related advice to buyers, sellers and lenders.

Prior to joining Stroock in 2007, Mr. Skroback practiced with the law firm of Hunton & Williams, where he was a senior environmental associate. From 1997 to 1999, Mr. Skroback clerked for the Hon. James G. Glazebrook, U.S. District Court for the Middle District of Florida.

Among his many representations, Mr. Skroback:

Regularly conducts all phases of environmental due diligence and permitting, negotiates environmental provisions in transactional documents, and provides advice in support of corporate mergers, acquisitions, development projects, financings, and other transactions. Examples include: the sale of a multi-national conglomerate of airline and automotive parts manufacturers located in the United States, the UK and China; development of a biodiesel facility in Texas; the transfer of large power plants in Illinois; the transfer of the transfer of three power plants in Kentucky; transfer of waste-to-energy facilities in Connecticut, Massachusetts and Maryland; etc.

Represented a Fortune 20 company with respect to potential liability at PCB contaminated sediments river site. Conducted joint defense among potentially responsible parties to CERCLA action brought by the United States at an NPL-listed Superfund Site spanning eighty miles of river with multiple Operable Units. Managed client’s involvement in regulatory cleanup process estimated by government to exceed $1 billion, negotiating with government agencies and directing consultants’ investigation, modeling, and cleanup activities. Managed client’s contribution claims against codefendants and conduct private party mediation, addressing equitable allocation of liability and discovery/document production issues.

Obtained successful settlement from the United States and state government on behalf of clients.

Successfully defended and settled lawsuit brought by the State of New York in the U.S. District Court for the S.D. of NY related to clients’ alleged CERCLA and other environmental liability at a landfill.

Successfully defended and settled lawsuit brought by major oil company in U.S. District Court in Illinois related to clients’ alleged CERCLA, OPA, and RCRA liabilities at a large oil refinery with cleanup costs estimated at $150 Million.

Obtained successful release of parent corporations under U.S. v. Bestfoods doctrine.

Responded to and negotiated settlement of FAA Notices of Probable Violation for shipments of potentially explosive materials in violation of DOT regulations.

Prepared analysis of when a duty to preserve records attaches, including analysis of hypothetical triggers for when a client should issue Disposal Suspension Notices.

Managed response of corporate PRPs to USEPA § 104(e) information requests at NPL Site.

Advised foreign corporation with respect to historical asbestos liabilities in the U.S.

Managed property transfer issues under New Jersey’s ISRA statute.

Experience addressing environmental issues in a bankruptcy context.

Managed ongoing CERCLA liability issues at various sites in the United States on behalf of an international corporation.
