Mr. Wurglitz practices in two principal areas: (1) government business relationships such as contracts, grants, and cooperative agreements, and (2) technology and services transactions such as technology and business process outsourcing, technology development agreements, and technology licensing and business transactions. Government Contracts: Mr. Wurglitz counsels, litigates, and lectures in many areas including government contract formation and negotiation; issues in commercialization and privatization; rights in technical data; GSA schedule contracts; computer and telecommunications procurements; claims preparation under supply, services and construction contracts; debarment and suspension proceedings; procurement fraud investigations and qui tam cases; contractor self-governance and compliance programs; defective pricing; cost recovery under contracts and grants; and equitable adjustments. For more than twenty-five years, Mr. Wurglitz has engaged in substantial litigation, including bid protest, contract dispute, false claim, qui tam and other matters, before the boards of contract appeals (BCA), federal district courts, the U.S. Court of Federal Claims, the U.S. Court of Appeals for the Federal Circuit, and the General Accounting (Accountability) Office (and before losing bid protest jurisdiction, the General Services Administration BCA and federal district courts), as well as agency-level protests and disputes before federal, state and local agencies. He also represents contractors and subcontractors in disputes between contractors, both in litigation and under alternative dispute resolution procedures. Technology and Services Transactions and Licensing: Mr. Wurglitz has over twenty-five years experience in technology and services transactions and licensing industries, including information technology, financial, insurance, health, defense, pharmaceutical, biotechnology, manufacturing and retail. He helps plan, negotiate and document computer, telecommunication, and business process outsourcing agreements, and also lectures in these areas. He represents clients in transactions involving computer system acquisition, software licensing and distribution, custom software development, and Internet and e-commerce arrangements. In addition, he advises on intellectual property protection for technology products and services. Mr. Wurglitz also represents clients in technology joint ventures, joint development agreements, and other complex technology transactions such as acquisition and divestiture of product and service lines. He also assists clients in litigation and arbitration of complex software performance, copyright infringement and trade secret misappropriation cases. Publications and Speaking Engagements: Mr. Wurglitz has authored publications and lectured on government contract marketing, intellectual property in government contracts and grants, competition in contracting, disputes and remedies, contract financing, contractor self-governance, outsourcing transactions, outsourcing disputes, restrictions on outsourcing, software licensing, software development, and open source licensing. Before joining Miles & Stockbridge in 2005, Mr. Wurglitz was a partner at O’Melveny & Myers LLP in its D.C. and Northern Virginia offices. He joined O’Melveny in 1993, after serving as General Counsel of a major systems integrator, software developer and professional services company headquartered in McLean, Virginia. While finishing his law degree at Loyola University Law School at night, Mr. Wurglitz served as a procurement officer in the U.S. Air Force space program in Los Angeles. Before then, he received a graduate degree in law and government from Oxford University in the U.K., studied law at New York University Law School, and received a Bachelor of Science degree from the U.S. Air Force Academy. Mr. Wurglitz served as a law clerk to federal judges on the Fifth and Tenth Circuit Courts of Appeals.
